This article focuses on the figure of the garden in a selection of novels and urban chronicles by José Donoso. A study of these works reveals that the garden fosters the legibility of subjects and urban landscapes within a space of power where aesthetic and political discourses confront each other/are debated. The figure of the garden emerges as a milestone in a written and urban landscape that attracts the vigilant gaze of strategists and the communal aspirations of dissidents.

This paper draws from the work of sixteenth century theologian, philosopher, and ethicist Domingo de Soto and considers his virtue-based approach to the ethical evaluation of commerce within an Aristotelian–Thomistic framework for the articulation of business and the common good. Particular attention is given to the fundamental emphasis placed by Soto in distinguishing between commerce as an activity and the specific conduct of persons engaging in commercial activity. The distinction between the material and the formal parts of the common good (...) is then employed to shed light on the way Soto articulates commercial practices, virtuous character, and the common good. It is concluded that Soto’s major contribution for business ethics is clarifying that the key element for the ethical evaluation of commerce is the embodiment of virtuous personal conduct in the exercise of commercial activity. In this framework, the fulfillment of commerce’s potential to contribute to the common good is thus fundamentally interconnected with putting virtues into practice. (shrink)

The genetic code has evolved from its initial non-degenerate wobble version until reaching its present state of degeneracy. By using the stereochemical hypothesis, we revisit the problem of codon assignations to the synonymy classes of amino-acids. We obtain these classes with a simple classifier based on physico-chemical properties of nucleic bases, like hydrophobicity and molecular weight. Then we propose simple RNA ring structures that present, overlap included, one and only one codon by synonymy class as solutions of a combinatory variational (...) problem. We compare these solutions to sequences of present RNAs considered as relics, with a high interspecific invariance, like invariant parts of tRNAs and micro-RNAs. We conclude by emphasizing some optimal properties of the genetic code. (shrink)

Theoretical minimal RNA rings are candidate primordial genes evolved for non‐redundant coding of the genetic code's 22 coding signals (one codon per biogenic amino acid, a start and a stop codon) over the shortest possible length: 29520 22‐nucleotide‐long RNA rings solve this min‐max constraint. Numerous RNA ring properties are reminiscent of natural genes. Here we present analyses showing that all RNA rings lack dinucleotide CG (a mutable, chemically instable dinucleotide coding for Arginine), bearing a resemblance to known CG‐depleted genomes. CG (...) in “incomplete” RNA rings (not coding for all coding signals, with only 3–12 nucleotides) gradually decreases towards CG absence in complete, 22‐nucleotide‐long RNA rings. Presumably, feedback loops during RNA ring growth during evolution (when amino acid assignment fixed the genetic code) assigned Arg to codons lacking CG (AGR) to avoid CG. Hence, as a chemical property of base pairs, CG mutability restructured the genetic code, thereby establishing itself as genetically encoded biological information. (shrink)

PRIVATIZAÇÃO DAS ÁGUAS: UMA ANÁLISE NA PERSPECTIVA LATINO AMERICANA A PARTIR DOS DIREITOS HUMANOS FUNDAMENTAIS.

Apesar do maior reconhecimento da importância das relações entre saúde, religião e espiritualidade no cuidado em saúde, as universidades brasileiras ainda não fornecem treinamento adequado nesse âmbito. O objetivo desse artigo é compreender como docentes de uma universidade pública brasileira percebem as relações entre saúde, religião, espiritualidade e seu ensino. 10 professores foram submetidos à entrevista semiestruturada e os dados foram analisados por meio da análise de conteúdo. Apreenderam-se três núcleos temáticos e, a partir destes, emergiram cinco categorias: Religião e (...) Espiritualidade: Conceitos superpostos?; Bom ou ruim para a saúde?; Dimensão excluída da prática clínica; Ensino: Seria bom, mas não agora; Questionamentos e barreiras à inclusão no ensino. Os resultados demonstraram que os participantes superpunham os conceitos de religião e espiritualidade, reconheceram seus impactos positivos sobre a saúde, entretanto, enfatizaram seus aspectos problemáticos. O ensino de saúde, religião e espiritualidade não foi considerado prioritário e as crenças do corpo docente parecem influenciar nesta posição. Diante da quantidade e qualidade das evidências científicas sobre o impacto positivo da religião/espiritualidade na saúde, a inserção desse tópico na formação dos profissionais de saúde não deve depender apenas das percepções e/ou preferências do corpo docente universitário. Brain–machine interfaces combining visual, auditory, and tactile feedback have been previously used to generate embodiment experiences during spinal cord injury rehabilitation. It is not known if adding temperature to these modalities can result in discomfort with embodiment experiences. Here, comfort levels with the embodiment experiences were investigated in an intervention that required a chronic pain SCI patient to generate lower limb motor imagery commands in an immersive environment combining visual, auditory, tactile, and thermal feedback. Assessments were made pre-/ post-, throughout (...) the intervention, and at 7 weeks follow up. Overall, high levels of embodiment in the adapted three-domain scale of embodiment were found throughout the sessions. No significant adverse effects of VR were reported. Although sessions induced only a modest reduction in pain levels, an overall reduction occurred in all pain scales at follow up. A high degree of comfort in the comfort scale for the thermal-tactile sleeve, in both the thermal and tactile feedback components of the sleeve was reported. This study supports the feasibility of combining multimodal stimulation involving visual, auditory, tactile, and thermal feedback to generate embodiment experiences in neurorehabilitation programs. The COVID-19 pandemic has led to the widespread use of online hearings in arbitral proceedings, raising questions about the impact of such proceedings on the determination of facts underlying a dispute. This article explores the extent to which online hearings may hinder arbitrators’ ability to assess witness credibility by drawing upon the cognitive psychology literature on truthfulness determination and lie detection. A survey of the literature suggests that the ability to differentiate truthful from dishonest statements through verbal and nonverbal cues (...) is limited, leading to the notion that observing behaviors like fidgeting, gaze aversion, vocal pitch, or body posture is not particularly relevant in assessing the credibility of a witness. Instead, focusing on the content of what is reported appears to be the most relevant strategy to determine credibility. Therefore, research does not support the idea that face-to-face contact with witnesses is essential to determine the facts of a dispute. Still, the use of in-person hearings may, in practice, continue to be preferred due to underlying cultural assumptions regarding the nature of hearings, the facilitation of communication between parties, counsel, and the tribunal, and a general sense of _Zoom fatigue_. Presenting a fascinating analysis of the idea of what can't be said, this book ascertains whether the notion of there being a truth, or a state of affairs, or knowledge that can't be expressed linguistically is a coherent notion. The author distinguishes different senses in which it might be said that something can't be said. The first part looks at the question of whether ineffability is a coherent idea. Part two evaluates two families of arguments regarding whether ineffable states of (...) affairs actually exist: the argument from mysticism and the argument from epistemic boundedness. Part three looks more closely at the relation between mystic and non-mystic stances. In the fourth and final part the author distinguishes five qualitatively different types of ineffability. _Ineffability and Philosophy_ is a significant contribution to this area of research and will be essential reading for philosophers and those researching and studying the philosophy of language. In this challenging study, André Gallois proposes and defends a thesis about the character of our knowledge of our own intentional states. Taking up issues at the centre of attention in contemporary analytic philosophy of mind and epistemology, he examines accounts of self-knowledge by such philosophers as Donald Davidson, Tyler Burge and Crispin Wright, and advances his own view that, without relying on observation, we are able justifiably to attribute to ourselves propositional attitudes, such as belief, that we consciously hold. Experiences of absence are common in everyday life, but have received little philosophical attention until recently, when two positions regarding the nature of such experiences surfaced in the literature. According to the Perceptual View, experiences of absence are perceptual in nature. This is denied by the Surprise-Based View, according to which experiences of absence belong together with cases of surprise. In this paper, I show that there is a kind of experience of absence—which I call frustrating absences—that has been overlooked (...) by the Perceptual View and by the Surprise Based-View and that cannot be adequately explained by them. I offer an alternative account to deal with frustrating absences, one according to which experiencing frustrating absences is a matter of subjects having desires for something to be present frustrated by the world. Lorenz proposed in his (1935) articulation of a theory of behavioral instincts that the objective of ethology is to distinguish behaviors that are “innate” from behaviors that are “learned” (or “acquired”). Lorenz’s motive was to open the investigation of certain “adaptive” behaviors to evolutionary theorizing. Accordingly, since innate behaviors are “genetic”, they are open to such investigation. By Lorenz’s light an innate/acquired or learned dichotomy rested on a familiar Darwinian distinction between genes and environments. Ever since Lorenz, ascriptions of innateness (...) have become widespread in the cognitive, behavioral, and biological sciences. The trend continues despite decades of strong arguments that show, in particular, the dichotomy that Lorenz invoked in his theory of behavioral instincts is literally false: no biological trait is the product of genes alone. Some critics suggest that the failure of Lorenz’s account shows that innateness is not well-defined in biology and the practice of ascribing innateness to various biological traits should be dropped from respectable science. Elsewhere (Ariew 1996) I argued that despite the arguments of critics, there really is a biological phenomenon underlying the concept of innateness. On my view, innateness is best understood in terms of C.H. Waddington’s concept of “canalization”, i.e. the degree to which a trait is innate is the degree to which its developmental outcome is canalized. The degree to which a developmental outcome is canalized is the degree to which the developmental process is bound to produce a particular endstate despite environmental fluctuations both in the development’s initial state and during the course of development. The canalization account differs in many ways to the traditional ways that ethologists such as Konrad Lorenz originally understood the concept of innateness. Most importantly, on the canalization account the distinction between innate and acquired is not a dichotomy, as Konrad Lorenz had it, but rather a matter of degree difference that lies along a spectrum with highly canalized development outcomes on the one end and highly environmentally sensitive development outcomes on the other end. Nevertheless, I justified the canalization account on the basis of a set of desiderata or criteria that I suggested falls-out of what seemed uncontroversial about Lorenz’s account of innateness (briefly): innateness is a property of a developing individual, innateness denotes environmental stability, and innate-ascriptions are useful in certain natural selection explanations (more below). From that same set of desiderata I argued (in my 1996) that neither the concept of heritability nor of norms of reactions—two concepts from population genetics—suffice to ground innateness. In this essay, I wish to provide further support of the canalization account in two ways. First, I wish to better motivate the desiderata by revisiting a debate between Konrad Lorenz and Daniel Lehrman over the meaning and explanatory usefulness of innate ascriptions in ethology. Second, I wish to compare my canalization account of innateness with accounts proposed by contemporary philosophers, one by Stephen Stich (1975), another by Elliott Sober (forthcoming), and a third by William Wimsatt (1986). Em diversas ocasiões, Leibniz recorre à autoridade de Aristóteles a fim de roborar sua tese da verdade como inerência do predicado ao sujeito da proposição. Não é, contudo, evidente em que medida a filosofia aristotélica poderia oferecer amparo a essa reivindica- ção. Afinal, a Aristóteles tradicionalmente se atribui uma concepção de verdade diferente, consistente em uma relação de correspondência entre a proposição e a realidade que ela se destina a descrever. Sem discutir a conhecida tese da verdade como correspondência, este (...) trabalho é dedicado a investigar em que medida os escritos de Aristóteles permitem que Leibniz respalde neles as suas afirmações. Para tanto, a presente investigação estará focada nos Primeiros e os Segundos Analíticos, obras em que Aristóteles expõe sua teoria do racio- cínio e da demonstração. Visa-se averiguar se, e sob que condições, a noção de inerência ali mobilizada pode ser assimilada à noção leibniziana de inerência. (shrink)

In daily academic life, students are exposed to a wide range of potentially stressful situations which could negatively affect their academic achievement and their health. Among the factors that could be weakened by academic stress, attention has been paid to expectations of self-efficacy, which are considered one of the most important determinants for student engagement, persistence, and academic success. From a proactive perspective, research on academic stress has emphasized the importance of coping strategies in preventing harmful consequences. In recent years, (...) there has been a growing interest in discovering the extent to which individuals are able to combine different coping strategies and the adaptive consequences this flexibility entails. However, studies using this person-centered approach are still scarce in the academic context. On that basis, this current study had two objectives: (a) to examine the existence of different profiles of university students based on how they combined different approach coping strategies (positive reappraisal, support seeking, and planning); and (b) to determine the existence of differences in general expectations of self-efficacy between those coping profiles. 1072 university students participated in the study. The coping profiles were determined by Latent Profile Analysis (LPA). The differences in the self-efficacy variable were determined using ANCOVA, with gender, university year, and degree type as covariates. Four approach coping profiles were identified: (a) low generalized use of approach coping strategies; (b) predominance of social approach coping approaches; (c) predominance of cognitive approach coping approaches; (d) high generalized use of approach coping strategies. The profile that showed that a greater combination of the three strategies was related to higher general self-efficacy expectations, and vice versa. These results suggest that encouraging flexibility in coping strategies would help to improve university students’ self-efficacy. (shrink)

This book presents a comprehensive and detailed exploration of the relationship between the thought of G.W.F. Hegel and that of John McDowell, the latter of whom is widely considered to be one of the most influential living analytic philosophers. It serves as a point of entry in McDowell’s and Hegel’s philosophy, and a substantial contribution to ongoing debates on perceptual experience and perceptual justification, naturalism, human freedom and action. The chapters gathered in this volume, as well as McDowell’s responses, make (...) it clear that McDowell’s work paves the way for an original reading of Hegel’s texts. His conceptual framework allows for new interpretive possibilities in Hegel’s philosophy which, until now, have remained largely unexplored. Moreover, these interpretations shed light on various aspects of continuity and discontinuity between the philosophies of these two authors, thus defining more clearly their positions on specific issues. In addition, they allow us to see Hegel’s thought as containing a number of conceptual tools that might be useful for advancing McDowell’s own philosophy and contemporary philosophy in general. Information is a central notion for cognitive sciences and neurosciences, but there is no agreement on what it means for a cognitive system to acquire information about its surroundings. In this paper, we approximate three influential views on information: the one at play in ecological psychology, which is sometimes called information for action; the notion of information as covariance as developed by some enactivists, and the idea of information as minimization of uncertainty as presented by Shannon. Our main thesis is (...) that information for action can be construed as covariant information, and that learning to perceive covariant information is a matter of minimizing uncertainty through skilled performance. We argue that the agent’s cognitive system conveys information for acting in an environment by minimizing uncertainty about how to achieve her intended goals in that environment. We conclude by reviewing empirical findings that support our view and by showing how direct learning, seen as instance of ecological rationality at work, is how mere possibilities for action are turned into embodied know-how. Finally, we indicate the affinity between direct learning and sense-making activity. (shrink)

Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

In this paper we put forward the thesis that qualia are tropes (or qualitons), and not (universal) properties. Further, we maintain that Wittgenstein hints in this direction. We also find in Wittgenstein elements of an account of language acquisition that takes the presence of qualia as an enabling condition. We conclude by pointing out some difficulties of this view.

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

This paper offers a new interpretation for Wittgenstein`s treatment of mathematical identities. As it is widely known, Wittgenstein`s mature philosophy of mathematics includes a general rejection of abstract objects. On the other hand, the traditional interpretation of mathematical identities involves precisely the idea of a single abstract object – usually a number –named by both sides of an equation.

Aesthetics and communications theories are often applied to art, media and popular culture but not within legal empirical (audiovisual) material—despite the fact that a judicial and legal process comprises a palpable utilisation of the visual as evidence of an historical reality. Based on four distinct Swedish cases, this study analyses the court’s reasoning, interpretation and use of (audio)visual evidence. Inspired by an embodied film theory, Benjamin’s thoughts on the technical-dramaturgical components of the camera and the later Barthes’ notion of the (...) ‘punctum’, the article discusses how (audio)visual evidence cannot be disconnected from affective and aesthetic significances that ultimately can be taken to affect the perception of truth and (the crime’s) reality. The gap between theory and practice is debated and argued as beginning to co-exist; instead of seeing (visual) theory and (judicial) practice as a dichotomy, an attempt should be made for a conversation between seemingly different but in practice related areas of knowledge. The author’s aim is to suggest that photographic and filmic evidence has a particular significance in itself, which means that the relation between (judicial) interpretation and outcome should be considered within an affective and aesthetic dimension, rather than being placed and/or theorized outside of it. Occupational health covers technical, medical, social and legal aspects. This article analyzes it from the perspective of biodiversity, specifically aspects related to risky behavior and its protective factors that are contained in binding international instruments, resolutions and declarations issued by the World Health Organization and the International Labor Organization, which seek to improve safety and health at work and in the environment. A bibliographic review of legal documents and scientific articles of reference was conducted to that end. The challenge is (...) to raise awareness among public and business policy-makers concerning the complexity of the phenomenon of work. Podese seguramente identificar como algumas das principais características da filosofia da educação, praticada por este autor, o rigor na apresentação das idéias e construção dos argumentos, além do amplo espectro de temas que aborda. Seu último livro, Doutrinas (...) pedagógicas: máquinas produtoras de litígio, é um testemunho da originalidade inerente ao seu pensamento, que focaliza, dessa feita, o exame de algumas doutrinas pedagógicas, as quais, a partir do século XVII, operam direta ou indiretamente nos discursos a respeito da educação escolar. The existence of causal explanations in science has been an issue of interest in Western philosophy from its very beginnings. That is the reason this work, following an idea of Mario Bunge, makes a historical review of this matter. The modern treatment of this subject takes place since the postulation by Popper and Hempel of the D-N model of scientific explanation, whose viability is scrutinized here from different points of view in the current philosophy of science. The main object of (...) this paper is to present two arguments against the possibility of causal explanations in theoretical physics. The first one concerns the existence, in certain cases, of inter-theoretical incompatibilities, and the second refers to the need to resort, in other cases, to concatenations of laws of different theories and disciplines. The final conclusion will be the defence of a form of theoretical explanation, which follows the Popper-Hempel model, but devoid of any ontological and metaphysical connotations. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. In this paper, I present a position that I call erotetic amelioration, according to which we must evaluate and, eventually, improve our answers to questions of the form “What is x?”. My focus will be on cases where x stands for a strongly social kind, such as marriage. Such a position is offered as an alternative to the idea-sometimes called conceptual engineering-according to which we should evaluate and, eventually, seek to improve our concepts. After introducing the idea of erotetic amelioration, (...) I will show how it can be put into work to deal with what I call the topic preservation challenge, and what advantages it has in relation to a similar position available in the literature, namely, Cappelen’s (2018) Austerity Framework. It is widely believed by philosophers that we human beings are capable of stepping back from inclinations to act in a certain way and consider whether we should do so. If we judge that there are enough reasons in favour of following our initial inclination, we are definitely motivated, and, if all goes well, we act. This view of human agency naturally leads to the idea that our actions are self-determined, or controlled by ourselves. Some go one step further to (...) the point of saying that we should extend the fundamental aspects of this view of human agency to the epistemic realm. This we call ‘the control-view”. Here we will make a strong case against the control-view. While we have a substantial control over our practical lives, it is very unlikely that this extends to our epistemic lives. Our discussion will proceed in three stages. We will present two asymmetries between our practical and epistemic lives which are followed by a general argument against the control-view. (shrink)

Moore’s Paradox is a test case for any formal theory of belief. In Knowledge and Belief, Hintikka developed a multimodal logic for statements that express sentences containing the epistemic notions of knowledge and belief. His account purports to offer an explanation of the paradox. In this paper I argue that Hintikka’s interpretation of one of the doxastic operators is philosophically problematic and leads to an unnecessarily strong logical system. I offer a weaker alternative that captures in a more accurate way (...) our logical intuitions about the notion of belief without sacrificing the possibility of providing an explanation for problematic cases such as Moore’s Paradox.
